Theodore Man Found Guilty of the Reckless Manslaughter of Veteran Air Force Staff Sargent

MOBILE, Alabama – A Theodore man has been found guilty of the Reckless Manslaughter of Justin Bolton, a Veteran Staff Sargent in the United States Air Force, announces Mobile County District Attorney Keith Blackwood.

In the early morning of October 28, 2021, Eric Timko was driving recklessly on Schillinger Road in West Mobile when his GMC pickup swerved across multiple lanes and struck Justin Bolton’s vehicle, causing Bolton’s immediate death.

A 3:30 a.m., Justin Bolton left his home, where his pregnant wife and two young children were sleeping, to head to work in Pascagoula, MS when he had that fatal encounter with Eric Timko. Testimony during Timko’s trial revealed that multiple calls were made reporting a vehicle driving recklessly prior to the incident.

Bolton served in the United States Air Force from 2009 to 2018 and was working as an electrician at Ingalls Shipbuilding at the time.

“All loss of life is tragic, but this type of loss is immeasurable,” said Mobile County District Attorney Keith Blackwood. “Mr. Bolton was an upstanding citizen, husband and father who died at the hands of someone who didn’t have a high regard for human life.”

The State was represented by Assistant District Attorneys Stuart Lang and Daniel Morris as well as Trial Coordinator Carolyn Lambeth.

Mobile County Circuit Court Judge Ben Brooks has scheduled sentencing for Eric Timko for December 11, 2024.
